Terms & Conditions

Lumen Studio Brisbane (The Studio)

Lumen Studio and Lumen House are located at 31 Sunrise Place, Hemmant 4174 and are owned by Leah Desborough and Paul Gates (The Owners). The Client who books the Studio will be known as the Hirer. These Terms and Conditions apply to Lumen Studio and Lumen House regardless of whether they are booked separately or together.

Bookings and Payment Terms

1. The time, date, and studio booking are not confirmed until full payment is made by the payment due date.
2. The Hirer must agree to and sign Lumen Studio’s Terms and Conditions at the ti me of payment.
3. The Owner of Lumen Studio is GST registered and will include 10% GST within fees.

Terms of Booking

1. The Hirer must confirm details of the hire purpose, areas of use, number and names of people attending, and hours of hire at the time of payment.
2. The Hirer, their staff , and representatives will only have access to the areas identified and agreed upon at the time of booking.
3. All personnel appointed by the Hirer must adhere to the House Rules and any details provided in the contract, or they may be asked to leave the location by the Owner.
4. The studio will be used for legal business activities only.
5. Hirers are solely responsible for any legal infractions committed by the Hirer or members of the Hirer’s party during usage.

Waiver of Liability

1. The Hirer agrees to assume all liability when hiring Lumen Studio and/or Lumen House for anyone attending or acting on its behalf for any loss, damage, accident, or injury to the Hirer or anyone accompanying the Hirer or acting for the Hirer while on the premises. The Hirer understands and agrees that the Owner, Lumen Studio, or Lumen House, shall not be held responsible or liable for any loss, damage, accident, or injury incurred while using the Studio, the house and their facilities.
2. The Hirer is solely responsible for the conduct and welfare of all persons accompanying the Hirer while on our premises.
3. The Hirer is solely responsible for the safety and well-being of any models, make-up artists, or others the Hirer engages.
4. The Hirer understands that if the Studio observes dangerous or negligent practices or activiti es by the Hirer or a member of the Hirer’s party, the Studio reserves the right to stop the shoot and require the Hirer and the Hirer’s party to leave immediately.
5. The Studio has no responsibility to determine or verify the age of participants in the Hirer’s activities but reserves the right to end those activities if it becomes aware of illegal or questionable activities.
6. If the Studio has to remove the Hirer for a violation of terms or because of illegal activity, no refunds will be given.
7. The use of Lumen Studio is at the Hirer’s own risk. The Hirer hereby waives the right to seek legal redress from the Owners or Lumen Studio for mishaps, accidents, and/or loss while on our premises.

Damages and Loss

1. Lumen Studio hires its photography studio space, including furniture and props, to its customers with the understanding that in no event shall the Studio be held liable for direct, indirect, incidental, or consequential damage due to the use of this facility or equipment used by its customers.
2. If an accident causing damage involving the Studio, furniture, equipment, or pool occurs while it is in the Hirer’s possession, the Hirer shall assume liability for replacement and inform the Owner with a written statement outlining the details of the event, including a police report and the names and addresses of witnesses, if applicable.
3. Any damages or loss to any part of this location or its property are the responsibility of the Hirer and their agents (photographer or commissioner) on the day. Signing the Lumen Studio contract represents full acceptance of and agreement to be bound by the terms contained within it.
4. The Hirer will be invoiced for the full cost of repairs or replacement of property resulting from damage caused during the shoot. Failure to comply with this requirement will result in the Hirer accepting full responsibility for the cost of any damages being claimed. By signing the Lumen Studio contract, the Hirer accepts and agrees to these terms and further accepts that the Owner of the Studio has the right to independently pursue a claim arising from any of the reasons stated above.

Cancellations

1.The Hirer must provide a minimum of 7 days’ notice in writing for any cancellations, and all reasonable efforts will be made to reschedule the booking.
2. Cancellations made under 7 days will incur a 50% cancellation fee of the total amount.
3. A cancellation fee equal to the total booking fee will occur should the Hirer be a no-show or cancel the booking with less than 48 hours’ notice.
4. The Studio is not liable for acts out of its control that may affect the desired outcome of the shoot, such as weather, force majeure, power outages, or emergencies.

Insurance

1. The Hirer must ensure that they and their agents (photographer, commissioner, etc.) have Public Liability Insurance to a minimum value of $10,000,000 and, in the case of a company, that they are authorized to sign the agreement.
2. A copy of the insurance document (Liability Certificate) must be made available to view on confirmation of booking.
3. Hirers should also carry Equipment Insurance.

Bump In and Bump Out Requirements

1. Your booking ti me includes all your bump in and bump out requirements, which include set up and pack up.
2. Please ensure you book an adequate amount of time. Ensure you arrive on time and are packed up and ready to leave by your scheduled finish time.
3. The Hirer is given a 15-minute grace period.
4. Any extra time required over your booking is charged at $100 per hour, pending availability.

Cleaning

1. The Hirer is required to treat the Studio, surrounds, and its furniture and fittings with care and respect.
2. The space will be clean and tidy for the Hirer’s arrival.
3. Upon entering the premises, the Owner will provide the Hirer with a tour and demonstration of facilities, equipment, and furniture at Lumen Studio (and Lumen House if applicable).
4. The Hirer will be required to sign a Condition Report prior to work commencing.
5. The Studio is to be left in a clean and tidy condition as found, and any damage must be documented in the Condition Report upon leaving the Studio.
6. General cleaning is included in the hire rate. If the studio is left in an unclean and unacceptable state, a $100 cleaning fee will be incurred.

House and Studio Rules

1. Smoking, alcohol, or pets are not permitted unless agreed with the Owner
2. Glitter, confetti , or paint is not to be used unless agreed with the Owner, and a cleaning fee will be incurred.
3. No use of the attached house or gardens outside of the agreed terms of the Contract.
4. No guests other than those identified on the booking agreement can access the Studio.
5. All care must be given to protect floors, walls, furniture from damage, and kitchen benches to avoid stains and scratches.
6. All rubbish must be removed or placed in bins provided.
7. Props and furniture must be returned to their original positions prior to exit.
8. Noise levels are to be kept to a fair level.

Minors on Set

1. Children in the Studio must be accompanied and supervised by an adult at all times. Children are not allowed to go into the pool without direct parental supervision.

Pool Access

1. Pool access may be requested and agreed upon in the Booking Contract

Parking

1. There is street parking available. Please be mindful of the narrow street and the ability for other cars to move freely.
2. Please avoid parking across neighboring driveways.
3. Usage of the main property driveway can be used but must be agreed upon prior to arrival.

Usage of Images

1. Any photographs taken at the location on the shoot day are authorized for use solely for the stated job and may not be re-used or sold for further usage without prior or subsequent agreement with Lumen Studio.
2. Occasionally, we may undertake marketing activities for the studio, including posting images on our website and social media platforms. Those marketing activities may include sharing or publishing images you have taken on the premises or those taken by the Owner. You consent to the Studio publishing any photograph or video footage that you have made on the premises, including (but not limited to) the publication of your name and image on our website and social media platforms and in any other materials at our discretion to promote our services and the premises.
3. You acknowledge, understand, and consent to us publishing your name, image, likeness, and your artistic works for the promotion of the Studio and our services, providing full credit to the Hirer and Author of the works.
